Bankruptcy Expertise

Altstadt Consulting personnel have applied their knowledge of accounting, finance, statistics and economics to a wide variety of matters arising out of Federal Bankruptcy actions. These matters include tracking of cash collateral, evaluation of the debtor's financial history, analysis of the financial and economic viability of proposed reorganization plans and various consultation in litigation arising from the initial bankruptcy. We have worked for both debtors and creditors and testified both in bankruptcy court and arbitration matters.

Selected Engagements

In Re: Grand Chevrolet (Peter White - Manning, Lever, Burder & Berberich) Mr. Altstadt analyzed and tracked $13 million of cash collateral on behalf of the primary secured creditor to a Southern California dealership.

In Re: Joe Conti Toyota (Merritt Spencer - Strasburger & Price) Mr. Altstadt  evaluated the performance of a Texas Toyota dealership in support of the creditor's challenge to the reorganization plan.

Roger Hogan v. Tokai Credit Corp. (Steve Bloom - Frandzel & Share) Mr. Altstadt  evaluated the financial performance of a Southern California Nissan dealership in support of a creditor's challenge to the reorganization plan.

In Re: Carlos O'Brien's Mr. Altstadt evaluated the debtor's proposed reorganization plan related to a Southern California restaurant.

In Re: Project Video Mr. Altstadt managed an engagement as trustee of an entertainment business in bankruptcy in Seattle, Washington.

In Re: Solemint Heights (Paul, Hastings, Janofsky & Walker) Mr. Altstadt evaluated the financial, economic and market assumptions made by the debtor related to an apartment complex in Santa Clarita, California.

In Re: Van's Cleaners (Joel Miliband - Rus, Miliband & Smith) Mr. Altstadt evaluated the financial actions taken by the trustee on behalf of debtor in a commercial action.

In Re: Evelyn Conroy (Jerry LaCues - Law Offices of Jerry LaCues) Mr. Altstadt quantified the debtor's basic financial needs in determining the amount of credit to be paid through the bankruptcy.

In Re: Engine Electronics, Inc. (Joel Miliband - Rus, Miliband & Smith) Mr. Altstadt prepared 10 year cash flow projections and debt amortization models for an after market automotive manufacturer on behalf of the debtor.

Pamela Ragland v. U.S. Bank, N.A. (Isaiah Weedn - Sheppard Mullin Richter & Hampton) Mr. Altstadt provided consulting services to the defendant in a Superior Court (Orange County) residential foreclosure matter.  Services included evaluating the plaintiff's ability to make mortgage payments during her Chapter 13 bankruptcy.

Ronald Peterson, Chapter 7 Trustee v. Imhoff, et al. (Don Hamman - Stuart Kane) Mr. Altstadt provided consulting services to the defendant in a United States District Court (New Jersey) breach of guaranty agreement matter.  Services included a complete accounting of $3 million in maintenance payments related to a residential/golf course development in Colorado.
